Fair Processing Notice

This Privacy Policy and Fair Processing Notice explains how we collect, use, store, share, and protect personal data in connection with the services we provide, including CCTV installation, vehicle equipment and technology, wireless and wired network services, and associated maintenance and servicing (together, the “Services”).

This notice encompasses all activities conducted in due course of all interactions and/or services conducted by Titan Systems (Guernsey).

We are committed to complying with the Data Protection (Bailiwick of Guernsey) Law, 2017 (the “Law”) and to ensuring that personal data is processed lawfully, fairly, and transparently.

The Data Protection Law

The Controller acknowledges its obligations under the Law, which sets out requirements in relation to processing activities involving personal data. The Controller further acknowledges the general principles of processing, as well as the rights of data subjects. Further information in relation to these provisions is provided within this Fair Processing Notice.

The Principles of Processing

Lawfulness, fairness, and transparency

The Controller acknowledges that all processing of personal data must be lawful, fair, and undertaken with transparency.

We may collect and process the following categories of personal data in the course of providing our Services.

None of the personal data collected for this purpose is classified as “Special Category Data” (the most sensitive data as defined by the Law). The personal data collected for this purpose may include:

Data subject details:

  • Name
  • Home, business, or organisation address
  • Email address
  • Contact telephone number
  • Company or organisation name where the service is provided for a business or organisation

We may also collect and store data relating to the services we provide, including:

  • CCTV and related data: images, video footage, and timestamps from CCTV systems we install or service
  • Building information: plans, diagrams, or information relating to the installation, servicing, or maintenance of fitted systems
  • Vehicle data: vehicle registration numbers, telematics testing data, or other vehicle-related data where systems are installed or maintained for diagnostic, testing, and quality assurance purposes only
  • Network and technical data: IP/MAC addresses, network logs, usage data, and diagnostic information collected as part of delivering or maintaining network services
  • Contract and service records: details of contracts, service requests, invoices, and payment information

We collect this data for purposes including:

  • Providing and maintaining our Services
  • Installing, configuring, and servicing equipment
  • Ensuring network and system security, troubleshooting, and diagnostics
  • Responding to service requests and managing contracts
  • Complying with legal obligations, including law enforcement or regulatory requests

Where CCTV or monitoring captures images or information relating to identifiable individuals, this constitutes personal data under the Law and will be processed lawfully, fairly, and transparently, with appropriate signage or notice where required.

We do not collect, store, monitor, or collate data relating to individual web pages or services that may be transmitted through any system we install. We do not view or monitor network traffic and have no capability or intention of tracking, monitoring, intercepting, or storing web service or browsing history.

Lawful Basis for Processing

We rely on one or more of the following legal bases under the Law for processing personal data:

  • Processing is necessary for the performance of a contract with you or your organisation
  • Processing is necessary for our legitimate interests in providing secure and effective Services, preventing and investigating misuse of equipment, and ensuring network integrity (balanced against data subject rights)
  • You have given consent for specific processing where applicable (for example, marketing or optional services)
  • Processing is necessary to comply with legal obligations

How We Use Personal Data

We use personal data to:

  • Deliver, install, maintain, and support the Services we provide
  • Communicate with you regarding service updates and support issues
  • Ensure systems operate correctly and securely
  • Fulfil legal, regulatory, or contractual obligations
  • Respond to requests from law enforcement or other authorities where permitted by law

Sharing Personal Data

We will not sell, transfer, or share your personal data with any third party.

However, we may share your data with:

  • Law enforcement or regulatory authorities where required by law or to protect legal rights
  • Third parties where you have given consent or where necessary to deliver the Services

Any sharing of CCTV footage or personal data will be undertaken in compliance with the Law and only upon receipt of a valid Data Protection release request.

Data Retention

We retain personal data only for as long as necessary to fulfil the purposes described above or to meet legal or regulatory requirements.

CCTV footage retention periods are determined by the relevant data controller and system requirements and will be deleted or anonymised when no longer required.

We do not retain CCTV data on behalf of our clients, customers, or contracted organisations. CCTV images and footage are retained by the relevant controller and/or processor at the location where the CCTV system is installed or operated. We only retain technical data relevant to the purposes described above.

Your Rights

Under the Data Protection (Bailiwick of Guernsey) Law, 2017, you have rights including:

  • The right to be informed about how your data is used
  • The right to access personal data we hold about you (Subject Access Request)
  • The right to request correction, erasure, or restriction of your data
  • The right to object to certain processing
  • The right to data portability (in certain circumstances)

An individual may make a complaint in writing to the Data Protection Authority under section 67 of the Law if they believe that a controller or processor has breached, or is likely to breach, an operative provision of the Law which affects, or is likely to affect, their personal data or data subject rights.

Security Measures

We implement appropriate technical and organisational measures to protect personal data against unauthorised access, unlawful processing, accidental loss, destruction, or damage.

To comply with this requirement, we store encrypted copies of data on business systems, cloud servers, and secure off-site storage media.

Changes to this Notice

We may update this Privacy Policy and Fair Processing Notice from time to time.

Any significant changes will be published on our website.
